Terms of Service

These terms apply to every web hosting service, domain name and other product you buy from HostHat (“we”, “us”). By placing an order or using our services you agree to them. Our Privacy Policy explains how we handle your personal information.

1. Your account

You must be at least 18 years old, or have a parent or guardian's consent, and give us accurate contact details. Keep them up to date in the client area — renewal notices, invoices and domain notices are sent to the email address on your account.

You are responsible for everything done through your account and your hosting logins, including by anyone you share them with. Keep your passwords private and tell us straight away if you think your account has been compromised.

2. Prices, invoices and payment

  • Prices are in Australian dollars. GST is added where it applies and shown on your invoice.
  • Services are billed in advance for the billing cycle you choose. Renewal invoices are emailed before the due date, and you can pay by PayPal or by direct bank transfer.
  • We may change our prices. A change applies from your next renewal, and we'll tell you before it takes effect.
  • If an invoice is not paid by its due date we will send reminders, and the related hosting service may be suspended until it is paid. Domains that are not renewed in time expire and may be lost; restoring an expired domain can attract a registry redemption fee.
  • Upgrades take effect straight away and are charged pro rata for the rest of the current billing cycle.

3. Cancellation and refunds

You can cancel a service at any time by emailing us or by simply not renewing it. Cancellation takes effect at the end of the period you have paid for, and your website, email and files are then removed from our servers.

Payments for a billing period already started are not refunded, and domain registrations, renewals and transfers cannot be refunded once processed because the registry charges us immediately. Nothing in these terms limits a refund you are entitled to under the Australian Consumer Law, for example if a service has a major failure.

4. Acceptable use

You must not use our services, or let anyone else use them, to:

  • break any law, or host material that is illegal in Australia;
  • host or distribute child sexual abuse material — we report this to authorities without notice;
  • infringe anyone's copyright, trademark or other rights;
  • send spam or unsolicited bulk email, or breach the Spam Act 2003;
  • run phishing pages, scams, malware, botnets or other harmful software;
  • attack, scan or gain unauthorised access to any system or network, including ours;
  • harass, threaten or defame anyone, or publish anyone's private information without their consent;
  • run cryptocurrency mining, public proxies or VPNs, IRC servers, file-sharing or backup storage unrelated to your website, or anything else that degrades the server for other customers.

If we receive a complaint about content on your service we may ask you to respond or remove it. Where we reasonably believe there is a serious risk to people, our network or our upstream providers, we may act first and contact you afterwards.

5. Resources and fair use

Each plan comes with the storage, bandwidth, email account and other limits listed for it. Shared hosting servers are used by many customers at once, so a single site that uses an unreasonable share of CPU, memory or disk activity may be throttled or temporarily restricted. We'll contact you first where we can and help you move to a plan that suits your site.

6. Backups and your content

You own your website content and data. You give us permission to store, copy and transmit it only as needed to provide the service.

We take regular backups of our servers to recover from failures, but they are not guaranteed and are not a substitute for your own backups. Keep your own copy of anything important, especially before making major changes to your site.

7. Domain names

  • We register domains on your behalf through accredited registrars. You must also comply with the rules of the registry for each extension, including the ICANN registrant rights and responsibilities for generic domains like .com, and the auDA licensing rules for .au domains.
  • The registrant details you provide must be accurate. For .au domains you must meet the eligibility rules, such as holding an ABN, ACN or trademark, or having an Australian presence.
  • A registration is not complete until the registry confirms it, and we cannot promise a domain will be available until then.
  • You may transfer your domain to another provider at any time while it is active and paid; we will supply the transfer code on request.

8. Suspension and termination

We may suspend or end a service if you breach these terms, don't pay an invoice, give us false information, or if a court, regulator or registry requires it. Where possible we will warn you and give you a chance to fix the problem first. If we end a service because of a serious breach, no refund is due for the remaining period.

9. Availability

We work hard to keep services online and aim for 99.9% uptime, but no hosting service can be uninterrupted. We may need to carry out maintenance, and we rely on datacentres, networks, registries and other suppliers outside our control.

10. Liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those rights.

To the extent the law allows, where a service is not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited to supplying the service again or paying the cost of having it supplied again. We are not liable for indirect or consequential loss, such as lost profits, revenue or data, and our total liability for any claim is limited to the fees you paid us for the affected service in the 12 months before the claim.

You agree to compensate us for any loss or claim we suffer because of content you host or your breach of these terms.

11. Changes to these terms

We may update these terms from time to time. We'll post the new version on this page and, for material changes, email you before they take effect. Continuing to use the service after that means you accept them.

12. Governing law

These terms are governed by the laws of Australia, and you and we submit to the jurisdiction of the Australian courts.
